Booking Terms and Conditions

In these Terms & Conditions
A. Payments are due upon receipt of this invoice.
B. "We", "our" and "us" means M.W.P.L.L.C., Moving with Pride L.L.C. and their employees, members and associates.
"You" and "your" means the person and/or firm booking our services, buying a product or paying an invoice.
C. "The contract is agreed" – by booking our service online, you understand and agree to our terms and conditions. You understand that you are making a purchase online for a service which, when paid will result in a contract with M.W.P.L.L.C. This also means additional charges can occur depending on your overall needs. For example, there is an additional fee for bulky / extremely heavy items such as safes, pianos etc...
D. By paying an invoice, you confirm that you are at least 18 years old.
REQUIREMENTS: For all hourly rated projects, a minimum deposit is required to book and reserve our services for a specific date and time. The deposit is the amount you will pay to reserve the date and time during the booking. We will invoice you separately for any additional time over the minimum amount of hours you reserved. If you book our services for a flat fee, a minimum deposit of 50% of your total flat rate will be required to reserve a date and time. Any additional charges will be sent separately after the services are rendered.
TRAVEL FEES: There is a travel fee for all projects that are 10 miles or more from 22079. This fee covers fuel, mileage and travel time to get to your location. *We will send an invoice for this fee to be paid after the services are rendered.*
Bulky and/or Extremely Heavy Items: There is an additional fee for the handling of items over 300 lbs. Items will be assessed and priced accordingly. *We will invoice you separately for this service if applicable.* Please keep in mind, that handling an extremely heavy item that has to go up or down the steps will cost more than handling an item that does not have to go up or down the steps.
PAYMENTS: We accept credit/debit cards, money orders, certified checks, PayPal or cash. A minimum deposit is required to reserve our service and you agree to pay the remaining balance if applicable, after the services are rendered. You shall pay all costs of collection, including without limitation, reasonable attorney fees, late fees and interest fees if applicable. In addition to any other right or remedy provided by law, if you fail to pay for our services when due, M.W.P.L.L.C. has the option to treat such failure to pay as a material breach of this contract and may cancel this contract and/or seek legal remedies.
INSURANCE COVERAGE: (Standard Repair or Replacement Coverage:) Included (free)
Covers up to $.60 per pound for any item damaged. Covers goods while they are being handled by our team. This covers goods while in transit by a storage container or a rental truck if loaded and unloaded by our crew.
(Full Coverage Insurance) is available at an extra cost, this products prices may vary and can be purchased by asking your sales representative for details. This insurance covers goods while they are being handled by our team. It also covers goods while in transit in a
storage container, as well as trucks if 26' or under if the container/truck is loaded and unloaded by our team.
TERM: This contract will terminate automatically upon completion of services and final payment from you, unless stated in writing otherwise and signed by both parties.
INDEMNIFICATION: You shall defend, indemnify and hold harmless M.W.P.L.L.C, our officers, officials, employees and associates from any and all claims, injuries, damages, losses or suits including attorney fees, arising out of or resulting from the acts, errors or omissions of the you or 3rd party in performance of this Agreement, except for injuries and damages caused by the sole negligence of M.W.P.L.L.C. our officers, officials, employees or associates.
WARRANTY: M.W.P.L.L.C. shall provide its services and meet its obligations under this contract in a timely and workmanlike manner, using knowledge and recommendations for performing the services which meet generally acceptable standards in M.W.P.L.L.C.'s community and region, and will provide a standard of care equal to, or superior to, care used by service providers like M.W.P.L.L.C. on similar projects.
ATTORNEY'S FEES TO PREVAILING PARTY: In any action arising here under or any separate action pertaining to the validity of this Agreement, the prevailing party shall be awarded reasonable attorney's fees and costs, both in the trial court and on appeal.
CANCELLATION FEE: You agree to pay a cancellation fee equivalent to 2 hours of service if you cancel, reschedule or postpone your project in less than 4 hours of the scheduled start time. You will pay 1 hour of service if cancelled, rescheduled or postponed in less than 24 hours but more than 4 hours of the scheduled start time . If you cancel, reschedule or postpone in 24 hours or more before scheduled start time there will be no charge assessed and your deposit will be fully refunded.
